Employers Win Big Under Ohio Supreme Court's Workers' Comp Ruling
Ohio's Supreme Court reversed over 25 years of worker's comp precedent, allowing employers to reclaim overpayments when injured workers are declared to have reached maximum medical improvement after receiving temporary total disability benefits.
 
 
 
Trucker's FLSA Retaliation and State Whistleblower Complaints Revived
The 6th U.S. Circuit Court of Appeals ruled that a trucker's complaints were sufficient to put his employer on notice of potential violations under the Fair Labor Standards Act (FLSA) and Michigan's Whistleblower Protection Act. This revived his retaliation and whistleblower claims.
 
 
 
Pizza Delivery Drivers Entitled to Vehicle Expense Reimbursement
A federal appeals court has ruled that pizza delivery drivers must be reimbursed for the cost of providing their vehicles for work under the FLSA. Employers are required to reimburse expenses, but the court stopped short of adopting a specific mileage rate or calculation.
