The 6th U.S. Circuit Court of Appeals upheld summary judgment on Americans with Disabilities Act (ADA) claims brought by a former employee with Tourette syndrome. One factor that led to the lawsuit's dismissal was the employer's attempt to provide reasonable accommodation.
 
 
 
Age and Disability Discrimination Claims Fail
An employee was terminated because of her refusal to provide a return-to-work date after nine months of medical leave, the 8th U.S. Circuit Court of Appeals found, affirming a lower court's dismissal of the employee's claims of a hostile work environment due to age and disability discrimination.
 
 
 
Canadian Case Shows High Costs of Failing to Prove Just Cause
A British Columbia Supreme Court decision last year serves as a reminder to employers in Canada: Allegations of "just cause" in employment terminations might be ruled fabricated, particularly if a company doesn't defend itself in court with legal representation.
